1. Who we are, and your agreement with us
GuestChatty is a product of PestoAI Inc., a Delaware corporation ("PestoAI", "we", "us", "our"). These Terms & Conditions ("Terms") are a legal agreement between you and PestoAI governing your use of GuestChatty, including this website and the GuestChatty chat on WhatsApp (together, the "Service").
By messaging GuestChatty, subscribing, or using the Service as a host, co-host or guest, you agree to these Terms. If you do not agree, do not use the Service.
Our Privacy policy is part of these Terms.
Please read section 11 (Disclaimer and limitation of liability) and section 14 (Governing law and disputes) carefully. They limit what you can recover from us and affect how disputes are resolved.
2. The Service and who uses it
- Host: a person who subscribes to GuestChatty and creates an AI support agent for a property they let (a "listing").
- Co-host: a person a host invites to help manage a listing's information and guests.
- Guest: a person a host or co-host invites to ask a listing's AI support agent questions during their stay.
- Listing information: the texts, pictures and other content hosts and co-hosts add to an AI support agent.
- AI answers: the replies the Service generates.
You must be at least 18 years old to be a host or co-host. Guests use the Service only when a host or co-host invites them.
3. Hosts and co-hosts
3.1 You are responsible for your listing information: that it is accurate, kept up to date and lawful, and that you have the right to share it. Do not add anything you do not want your guests to see.
3.2 Do not add passwords for accounts, payment card numbers, government identity documents, health information or other sensitive personal information about yourself or anyone else, beyond what your guests genuinely need for their stay, such as a door or wifi code.
3.3 You may invite only guests and co-hosts who have agreed to receive an invitation from us. You are responsible for the dates you give your guests, and for removing anyone's access when it should end.
3.4 You are responsible for your relationship with your guests, including your bookings, house rules, payments, refunds and reviews, and for complying with the laws that apply to letting your property. PestoAI is not a party to that relationship.
3.5 You are responsible for what your co-hosts do with your listing.
4. Guests
4.1 You may use the Service only for the listing you were invited to, and only during the dates your host set.
4.2 Answers are based on the information your host gave. Check anything important with your host.
5. AI answers
5.1 The Service uses artificial intelligence. AI answers are generated by prediction and may be inaccurate, incomplete, out of date or unsuitable, even when they sound confident. They may include statements that were never in the listing information.
5.2 AI answers are not professional, legal, medical or safety advice, and must not be relied on as such.
5.3 Hosts are responsible for the listing information the answers are based on, and for checking how their AI support agent answers.
5.4 To the maximum extent permitted by law, PestoAI accepts no liability for AI answers, or for any decision, loss or damage arising from them.
6. Not an emergency service
GuestChatty is not an emergency service and must not be relied on in an emergency. In an emergency, call the local emergency services. Hosts must give their guests a direct way to reach them.
7. Subscriptions, payment and cancellation
7.1 Hosts need an active subscription to use the Service. The plan, its price and its billing cycle are shown when you subscribe. Payments are handled by our payment processor.
7.2 Subscriptions renew automatically at the end of each billing cycle at the then-current price until you cancel, and you authorise us to charge your payment method for each renewal.
7.3 You can cancel at any time by asking in the GuestChatty chat. When you cancel, your AI support agents stop answering guests. Fees already paid are not refunded, except where the law requires it.
7.4 Plans set limits, such as the number of listings, guests and co-hosts, and the amount of listing information. We may change our prices and plans, with at least 30 days' notice before a change applies to your subscription.
7.5 Prices exclude taxes, which you are responsible for where they apply.
8. Acceptable use
You must not use the Service to:
- break any law or anyone's rights;
- share content that is unlawful, harmful, harassing, hateful, deceptive, or sexual content involving minors;
- impersonate anyone;
- send spam, or messages someone has not agreed to receive;
- access, or try to access, accounts, listings or systems that are not yours, or interfere with the Service; or
- copy, reverse engineer or resell the Service.
We may remove content, or suspend or close access, if we reasonably believe these Terms are being broken.
9. Your content, and ours
9.1 You keep ownership of the listing information and messages you send. You give us a worldwide, non-exclusive, royalty-free licence to host, copy, process and show them to the people you invite, only as needed to run the Service and as the law requires.
9.2 The Service, its software and designs, and the GuestChatty and PestoAI names and logos belong to us.
10. Availability, WhatsApp and changes
10.1 We aim to keep the Service available, but we do not promise that it will be uninterrupted or error-free.
10.2 The Service runs on WhatsApp, which a third party provides under its own terms. We are not responsible for WhatsApp's availability, rules or changes, and a change by WhatsApp may affect or interrupt the Service.
10.3 We may add, change or remove features at any time.
11. Disclaimer and limitation of liability
11.1 To the maximum extent permitted by law, the Service, including all AI answers, is provided "as is" and "as available", without warranties of any kind, including merchantability, fitness for a particular purpose, accuracy and non-infringement.
11.2 To the maximum extent permitted by law, PestoAI, its affiliates, and their officers, employees and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, bookings, revenue, reviews, data or goodwill.
11.3 To the maximum extent permitted by law, our total liability arising out of or relating to the Service or these Terms will not exceed the greater of the fees you paid us in the 12 months before the event giving rise to the claim, or one hundred US dollars (US$100).
11.4 Nothing in these Terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud, and nothing affects consumer rights that cannot be waived.
12. Indemnity
Hosts and co-hosts will defend, indemnify and hold harmless PestoAI, its affiliates, and their officers, employees and agents from any claim, loss, liability, fine or reasonable legal costs arising from their listing information, their dealings with their guests, their breach of these Terms, or their breach of any law.
13. Suspension and termination
We may suspend or close your access if you break these Terms, if a payment fails, where the law requires it, or to protect the Service or others. You can stop using the Service at any time, and you can delete your account by saying "Delete my account" in the GuestChatty chat, which deletes your AI support agents and their information.
14. Governing law and disputes
14.1 These Terms, and any dispute about them or the Service, are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules. If you are a consumer living where the law gives you the protection of mandatory local rules, you keep the benefit of those rules and may bring proceedings in your local courts.
14.2 Before starting proceedings, contact us at support@guestchatty.com, and we will try in good faith to resolve the dispute within 30 days.
14.3 Except where the law does not allow it, any dispute not resolved informally will be settled by binding individual arbitration administered by the American Arbitration Association under its applicable rules, seated in Wilmington, Delaware, in English. You may opt out of arbitration by emailing support@guestchatty.com within 30 days of first accepting these Terms. Where arbitration does not apply, the state and federal courts located in Delaware have exclusive jurisdiction, subject to section 14.1.
14.4 To the maximum extent permitted by law, disputes may be brought only individually, and not as part of a class or representative proceeding.
15. General
15.1 We may update these Terms. We will change the effective date above, and give hosts reasonable notice of material changes by email or in the chat. Using the Service after that means you accept the updated Terms.
15.2 If a provision is unenforceable, the rest remains in force. A failure to enforce a provision is not a waiver of it. We may assign these Terms in connection with a merger, acquisition or sale of assets.
15.3 These Terms are written in English. Any translation is for convenience, and the English version prevails.

1. Chi siamo e il tuo accordo con noi
GuestChatty è un prodotto di PestoAI Inc., una società del Delaware ("PestoAI", "noi", "nostro"). I presenti Termini e condizioni ("Termini") sono un accordo legale tra te e PestoAI che regola l'uso di GuestChatty, incluso questo sito web e la chat di GuestChatty su WhatsApp (insieme, il "Servizio").
Scrivendo a GuestChatty, abbonandoti o usando il Servizio come host, co-host od ospite, accetti questi Termini. Se non li accetti, non usare il Servizio.

Leggi con attenzione la sezione 11 (Esclusione di garanzie e limitazione di responsabilità) e la sezione 14 (Legge applicabile e controversie): limitano ciò che puoi ottenere da noi e stabiliscono come si risolvono le controversie.
2. Il Servizio e chi lo usa
- Host: chi si abbona a GuestChatty e crea un agente di supporto AI per un alloggio che affitta.
- Co-host: chi viene invitato da un host ad aiutarlo a gestire le informazioni e gli ospiti di un alloggio.
- Ospite: chi viene invitato da un host o da un co-host a fare domande all'agente di supporto AI di un alloggio durante il soggiorno.
- Informazioni dell'alloggio: i testi, le foto e gli altri contenuti che host e co-host aggiungono a un agente di supporto AI.
- Risposte AI: le risposte generate dal Servizio.
Per essere host o co-host devi avere almeno 18 anni. Gli ospiti usano il Servizio solo quando un host o un co-host li invita.
3. Host e co-host
3.1 Sei responsabile delle informazioni del tuo alloggio: che siano corrette, aggiornate e lecite, e che tu abbia il diritto di condividerle. Non aggiungere nulla che non vuoi far vedere ai tuoi ospiti.
3.2 Non aggiungere password di account, numeri di carte di pagamento, documenti d'identità, informazioni sanitarie o altre informazioni personali sensibili su di te o su altri, oltre a ciò che serve davvero ai tuoi ospiti per il soggiorno, come il codice della porta o del wifi.
3.3 Puoi invitare solo ospiti e co-host che hanno accettato di ricevere un nostro invito. Sei responsabile delle date che assegni ai tuoi ospiti e della revoca dell'accesso di chiunque quando deve terminare.
3.4 Sei responsabile del rapporto con i tuoi ospiti, incluse prenotazioni, regole della casa, pagamenti, rimborsi e recensioni, e del rispetto delle leggi che si applicano all'affitto del tuo alloggio. PestoAI non è parte di tale rapporto.
3.5 Sei responsabile di ciò che i tuoi co-host fanno con il tuo alloggio.
4. Ospiti
4.1 Puoi usare il Servizio solo per l'alloggio a cui sei stato invitato e solo nelle date stabilite dal tuo host.
4.2 Le risposte si basano sulle informazioni fornite dal tuo host. Verifica con il tuo host tutto ciò che è importante.
5. Risposte AI
5.1 Il Servizio usa l'intelligenza artificiale. Le risposte AI sono generate per previsione e possono essere inesatte, incomplete, non aggiornate o inadatte, anche quando sembrano sicure. Possono contenere affermazioni che non erano nelle informazioni dell'alloggio.
5.2 Le risposte AI non sono consulenza professionale, legale, medica o di sicurezza, e non devono essere usate come tale.
5.3 Gli host sono responsabili delle informazioni dell'alloggio su cui si basano le risposte e di verificare come risponde il loro agente di supporto AI.
5.4 Nella misura massima consentita dalla legge, PestoAI non si assume alcuna responsabilità per le risposte AI, né per decisioni, perdite o danni che ne derivino.
6. Non è un servizio di emergenza
GuestChatty non è un servizio di emergenza e non deve essere usato in caso di emergenza. In caso di emergenza, chiama i servizi di emergenza locali. Gli host devono dare ai propri ospiti un modo diretto per contattarli.
7. Abbonamenti, pagamenti e disdetta
7.1 Per usare il Servizio, gli host hanno bisogno di un abbonamento attivo. Il piano, il prezzo e il ciclo di fatturazione vengono mostrati al momento dell'abbonamento. I pagamenti sono gestiti dal nostro fornitore di servizi di pagamento.
7.2 Gli abbonamenti si rinnovano automaticamente alla fine di ogni ciclo di fatturazione al prezzo in vigore, finché non li disdici, e ci autorizzi ad addebitare ogni rinnovo sul tuo metodo di pagamento.
7.3 Puoi disdire in qualsiasi momento chiedendolo nella chat di GuestChatty. Quando disdici, i tuoi agenti di supporto AI smettono di rispondere agli ospiti. Gli importi già pagati non vengono rimborsati, salvo quando la legge lo richiede.
7.4 I piani prevedono dei limiti, come il numero di alloggi, ospiti e co-host e la quantità di informazioni dell'alloggio. Possiamo modificare prezzi e piani, con un preavviso di almeno 30 giorni prima che una modifica si applichi al tuo abbonamento.
7.5 I prezzi non includono le imposte, che sono a tuo carico quando dovute.
8. Uso consentito
Non puoi usare il Servizio per:
- violare leggi o diritti altrui;
- condividere contenuti illeciti, dannosi, molesti, d'odio, ingannevoli o contenuti sessuali che coinvolgono minori;
- impersonare qualcuno;
- inviare spam o messaggi che il destinatario non ha accettato di ricevere;
- accedere, o tentare di accedere, ad account, alloggi o sistemi non tuoi, o interferire con il Servizio; o
- copiare, decodificare o rivendere il Servizio.
Possiamo rimuovere contenuti, o sospendere o chiudere l'accesso, se riteniamo ragionevolmente che questi Termini vengano violati.
9. I tuoi contenuti e i nostri
9.1 Le informazioni dell'alloggio e i messaggi che invii restano tuoi. Ci concedi una licenza mondiale, non esclusiva e gratuita per ospitarli, copiarli, elaborarli e mostrarli alle persone che inviti, solo per quanto necessario a far funzionare il Servizio e per quanto richiesto dalla legge.
9.2 Il Servizio, il suo software e il suo design, e i nomi e i loghi GuestChatty e PestoAI appartengono a noi.
10. Disponibilità, WhatsApp e modifiche
10.1 Ci impegniamo a mantenere il Servizio disponibile, ma non garantiamo che sia ininterrotto o privo di errori.
10.2 Il Servizio funziona su WhatsApp, fornito da terzi secondo i propri termini. Non siamo responsabili della disponibilità, delle regole o delle modifiche di WhatsApp, e una modifica da parte di WhatsApp può influire sul Servizio o interromperlo.
10.3 Possiamo aggiungere, modificare o rimuovere funzionalità in qualsiasi momento.
11. Esclusione di garanzie e limitazione di responsabilità
11.1 Nella misura massima consentita dalla legge, il Servizio, incluse tutte le risposte AI, è fornito "così com'è" e "come disponibile", senza garanzie di alcun tipo, incluse quelle di commerciabilità, idoneità a uno scopo particolare, accuratezza e non violazione.
11.2 Nella misura massima consentita dalla legge, PestoAI, le sue affiliate e i loro dirigenti, dipendenti e fornitori non saranno responsabili di danni indiretti, incidentali, speciali, consequenziali o punitivi, né di perdite di profitti, prenotazioni, ricavi, recensioni, dati o avviamento.
11.3 Nella misura massima consentita dalla legge, la nostra responsabilità complessiva derivante dal Servizio o da questi Termini non supererà il maggiore tra gli importi che ci hai pagato nei 12 mesi precedenti l'evento che ha dato origine alla pretesa e cento dollari statunitensi (100 USD).
11.4 Nulla in questi Termini esclude la responsabilità che non può essere esclusa per legge, incluse quella per morte o lesioni personali causate da negligenza e quella per frode, e nulla pregiudica i diritti dei consumatori a cui non si può rinunciare.
12. Manleva
Host e co-host terranno indenni e manlevati PestoAI, le sue affiliate e i loro dirigenti, dipendenti e agenti da qualsiasi pretesa, perdita, responsabilità, sanzione o ragionevole spesa legale derivante dalle informazioni del loro alloggio, dai loro rapporti con i propri ospiti, dalla violazione di questi Termini o di qualsiasi legge.
13. Sospensione e chiusura
Possiamo sospendere o chiudere il tuo accesso se violi questi Termini, se un pagamento non va a buon fine, quando la legge lo richiede o per proteggere il Servizio o altre persone. Puoi smettere di usare il Servizio in qualsiasi momento ed eliminare il tuo account scrivendo "Elimina il mio account" nella chat di GuestChatty: verranno eliminati i tuoi agenti di supporto AI e le loro informazioni.
14. Legge applicabile e controversie
14.1 Questi Termini, e qualsiasi controversia relativa a essi o al Servizio, sono regolati dalle leggi dello Stato del Delaware, Stati Uniti, senza riguardo alle sue norme sui conflitti di legge. Se sei un consumatore e risiedi in un luogo la cui legge ti garantisce la protezione di norme locali imperative, mantieni il beneficio di tali norme e puoi agire davanti ai tribunali del tuo luogo di residenza.
14.2 Prima di avviare un procedimento, contattaci a support@guestchatty.com: cercheremo in buona fede di risolvere la controversia entro 30 giorni.
14.3 Salvo dove la legge non lo consente, qualsiasi controversia non risolta in via informale sarà decisa mediante arbitrato individuale vincolante amministrato dall'American Arbitration Association secondo le sue regole applicabili, con sede a Wilmington, Delaware, in lingua inglese. Puoi rinunciare all'arbitrato scrivendo a support@guestchatty.com entro 30 giorni dalla prima accettazione di questi Termini. Dove l'arbitrato non si applica, i tribunali statali e federali con sede nel Delaware hanno competenza esclusiva, fatto salvo quanto previsto dalla sezione 14.1.
14.4 Nella misura massima consentita dalla legge, le controversie possono essere promosse solo a titolo individuale, e non nell'ambito di azioni collettive o rappresentative.
15. Disposizioni generali
15.1 Possiamo aggiornare questi Termini. Modificheremo la data di entrata in vigore indicata sopra e daremo agli host un ragionevole preavviso delle modifiche sostanziali via email o in chat. Continuare a usare il Servizio dopo tale data significa accettare i Termini aggiornati.
15.2 Se una disposizione non è applicabile, le altre restano in vigore. Il mancato esercizio di un diritto non costituisce rinuncia allo stesso. Possiamo cedere questi Termini in caso di fusione, acquisizione o cessione di beni.
15.3 Questi Termini sono redatti in inglese. Qualsiasi traduzione è fornita per comodità e, in caso di differenze, prevale la versione inglese.
